These Terms of Use (“Terms”) govern your use of Asthma Tracker (“App”), published by Code With Chris (“Licensor,” “we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
Apple Inc. (“Apple”) is not a party to these Terms except as stated in Section 12.
1. License Grant
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely for personal, non-commercial use, as permitted by the Apple Media Services Terms and App Store rules.
2. Medical Disclaimer — Read Carefully
Asthma Tracker is for personal tracking and record-keeping only.
The App:
- Does not provide medical advice, diagnosis, or treatment
- Does not replace care from a qualified healthcare professional
- Does not detect, predict, or alert you to asthma attacks or emergencies
- Does not tell you whether to use medication or change your treatment plan
Zone colors, trends, reminders, and reports are based on information you enter and settings you configure. They are informational tools only.
Always consult your clinician about your asthma management, medication, and what to do if symptoms worsen. In an emergency, call your local emergency number.
You use the App at your own risk. We are not responsible for health decisions you make based on the App.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to accept these Terms. If you use the App on behalf of someone else (e.g., a family member), you represent that you have authority to do so and will use the App responsibly.
4. Subscriptions and Purchases
The App offers paid access, which may include:
- Lifetime unlock — one-time purchase
- Monthly subscription — auto-renewing subscription, which may include a free trial if offered at purchase
Current prices are shown in the App before purchase. Prices may change for new purchases; existing subscriptions follow Apple’s renewal rules.
Auto-Renewing Subscriptions
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device.
- Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
We use RevenueCat to validate entitlements. Purchase fulfillment is through Apple’s App Store.
Refunds
Refund requests are handled by Apple under App Store policies. We cannot issue App Store refunds directly.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Reverse engineer, decompile, or attempt to extract source code except as allowed by law
- Circumvent paywalls, licensing, or security features
- Use the App as a substitute for professional medical care or emergency response
- Misrepresent App output as clinical guidance or a medical device claim
6. Your Data and Privacy
Your health log is stored on your device unless you export or share it. We do not operate cloud accounts for your log data. See our Privacy Policy.
You are responsible for:
- Accuracy of data you enter
- Backing up your device if you want to preserve data
- Any sharing of PDF exports or screenshots
7. Intellectual Property
The App, including design, code, text, and graphics (excluding your user-entered data), is owned by Licensor and protected by copyright and other laws. These Terms do not transfer ownership to you.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or reliable for medical purposes.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING ANY HEALTH-RELATED DECISIONS OR OUTCOMES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Licensor from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App, violation of these Terms, or sharing of exported data.
11. Termination
These Terms remain in effect while you use the App. We may suspend or terminate access if you violate these Terms. Upon termination, your license ends and you must stop using the App. Sections that by nature should survive (disclaimers, liability limits, indemnity, governing law) will survive.
12. Apple-Specific Terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and Licensor, not Apple.
- Apple has no obligation to furnish maintenance or support for the App.
- Apple is not responsible for product claims, intellectual property infringement claims, or third-party claims related to the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. government embargo or on a U.S. government prohibited-party list.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes constitutes acceptance. If you do not agree, stop using the App and cancel any subscription through Apple.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply.
