These Terms and Conditions (“Terms”) are a legal agreement between you and Code With Chris (“we,” “us,” or “our”) for your use of the Custody Exchange Log mobile application (the “App”).

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Questions? Contact care@codewithchris.com.

1. The App

Custody Exchange Log is a personal documentation tool that helps you log custody exchanges, track planned versus actual parenting time, and generate reports (including PDF exports) from records you create.

The App is not a law firm, mediator, court, or government agency. It does not provide legal advice, legal representation, or guaranteed outcomes in any legal proceeding.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the App and agree to these Terms. By using the App, you represent that you meet this requirement.

The App is intended for parents and guardians. If you enter information about a child, you represent that you have the legal authority to do so.

3. License

Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, as permitted by Apple’s App Store Terms of Service.

You may not:

  • Copy, modify, reverse engineer, decompile, or create derivative works of the App except as allowed by law
  • Rent, lease, sell, sublicense, or distribute the App
  • Use the App for any unlawful purpose
  • Remove or alter proprietary notices

4. Subscriptions, Purchases, and Billing

Access to the App requires a paid purchase or subscription processed through Apple’s App Store. Current offerings may include:

ProductDescription
Lifetime accessOne-time purchase for ongoing access (currently $19.99)
Monthly subscriptionAuto-renewing monthly access (currently $3.99/month)

Free trial: The monthly plan may include a 7-day free trial where offered. If you do not cancel before the trial ends, your subscription converts to a paid subscription and Apple charges your App Store account at the then-current price.

Auto-renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

Manage or cancel: You manage subscriptions and turn off auto-renewal in your Apple ID Settings → Subscriptions. Deleting the App does not cancel a subscription.

Restore purchases: Use Restore Purchases in the App if you reinstall or switch devices. Restore relies on your Apple ID purchase history.

Price changes: We may change prices for new purchases or renewals where permitted by Apple and applicable law. Apple will notify you of price changes that affect your subscription when required.

Refunds: All payments are handled by Apple. Refund requests must be submitted to Apple in accordance with Apple’s refund policies. We cannot issue App Store refunds directly.

Purchase validation is supported by RevenueCat as our subscription management provider.

5. Your Records and Responsibilities

You are solely responsible for:

  • The accuracy, completeness, and legality of information you enter
  • How you use, share, or present exported reports (including PDFs)
  • Complying with court orders, parenting plans, privacy laws, and any obligations owed to other parties
  • Maintaining backups appropriate to your situation (including iCloud sync and manual exports)

The App may flag certain entries (for example, retroactive logs or edits) to support transparency. Those indicators are informational only and do not determine legal significance.

No guarantee of admissibility: We make no promise that any record, report, or export will be accepted, admitted, or given any particular weight by a court, attorney, mediator, or other third party.

6. Not Legal Advice

The App, its reports, and any related materials are provided for general informational and organizational purposes only. They are not a substitute for advice from a qualified attorney licensed in your jurisdiction.

You should consult an attorney about your specific situation, including whether and how to use documentation in legal proceedings.

7. iCloud Sync and Data

If enabled, your data may sync through Apple’s iCloud/CloudKit services to your private iCloud account. Sync availability depends on your device, iOS version, network connection, and Apple ID settings.

We do not operate a separate cloud account for your records. We are not responsible for data loss caused by device failure, loss of iCloud access, account issues, user error, or circumstances outside our reasonable control. You are encouraged to use exports and iCloud backup as appropriate.

8. Privacy

Our Privacy Policy explains how we handle information. By using the App, you also agree to the Privacy Policy.

9. Intellectual Property

The App, including its design, code, trademarks, and documentation (excluding content you create), is owned by Code With Chris and its licensors and is protected by intellectual property laws.

You retain ownership of the content you create in the App. You grant us no license to your content except the limited technical processing needed to operate the App on your device (and in your iCloud, if enabled).

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that any report will meet the requirements of a specific court, attorney, or agency.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Code With Chris will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the App.
  • Our total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months before the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Code With Chris from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate access to the App if you violate these Terms or if required by law or Apple.

You may stop using the App at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.

14. Changes to the App and Terms

We may update the App or these Terms from time to time. If we make material changes to these Terms, we will update the “Last updated” date and may provide additional notice in the App or on our website. Continued use after changes become effective constitutes acceptance of the revised Terms.

15. Apple Terms

You acknowledge that:

  • These Terms are between you and Code With Chris, not Apple.
  • Apple has no obligation to provide maintenance or support for the App.
  • Apple is not responsible for product claims, legal claims, or third-party intellectual property claims relating to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Your use of the App must also comply with applicable App Store terms and policies.

16. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your place of residence apply.

Any dispute arising from these Terms or the App will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise. You consent to personal jurisdiction in those courts.

Before filing a claim, you agree to contact us at care@codewithchris.com and attempt to resolve the dispute informally.

17. Miscellaneous

  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
