These Terms and Conditions (“Terms”) govern your use of the Gout Tracker: Flare & Diet Log mobile application (“Gout Tracker” or the “App”) provided by CodeWithChris (“we,” “us,” or “our”).
Please read these Terms carefully before using the App. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. The App and Your License
Subject to these Terms and payment of applicable fees (or an active free trial, where offered), we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for your personal, non-commercial use, and only as permitted by the App Store Terms of Service and Apple’s usage rules.
You may not:
- Copy, modify, distribute, sell, lease, or sublicense the App except as allowed by law
- Reverse engineer or attempt to extract source code from the App except where prohibited restrictions are not enforceable under applicable law
- Use the App to provide regulated medical services to others or represent the App as a clinical decision-support product
- Remove proprietary notices from the App or its content
- Use the App in any unlawful manner or in a way that could harm us, Apple, or other users
All rights not expressly granted are reserved.
2. Not Medical Advice
Gout Tracker is a personal logging and food-reference tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
The App may help you record flares, uric acid readings, medications, habits, and meals, and look up approximate purine content in foods. This information is provided for personal reference and organization only.
You acknowledge and agree that:
- The App does not provide medical advice, diagnosis, or treatment recommendations
- Food purine values, risk bands, and insights are informational only and may be incomplete, outdated, or inaccurate for your situation
- You must consult a qualified healthcare professional before making decisions about your health, medications, diet, or treatment plan
- You are solely responsible for how you use information recorded in or displayed by the App
Never disregard professional medical advice or delay seeking it because of something in the App.
If you think you may have a medical emergency, call your doctor or emergency services immediately.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you represent that you have permission from a parent or legal guardian.
4. Purchases, Subscriptions, and Free Trials
The App offers premium access through in-app purchases processed by Apple, which may include:
| Plan | Type | Notes |
|---|---|---|
| Lifetime | One-time non-consumable purchase | No free trial |
| Monthly | Auto-renewable subscription | May include a 7-day free trial, then renews monthly unless canceled |
Prices are shown in the App and App Store at the time of purchase and may vary by region. Taxes may apply where required.
Billing and renewal
- Payment is charged to your Apple ID account
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your account may be charged for renewal within 24 hours prior to the end of the current period
- Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable
Managing purchases
- Manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device
- Use Restore Purchases in the App to restore previously purchased access on a device signed in with the same Apple ID
- Refund requests are handled by Apple according to Apple’s policies
We use RevenueCat to validate purchase entitlements. Apple remains the merchant of record for App Store transactions.
5. Food and Reference Data
Purine content values in the App are derived from publicly available data sources, including the U.S. Department of Agriculture (USDA) and the NIH Office of Dietary Supplements (ODS-NIH), and are bundled for offline reference.
You understand that:
- Values are approximate and may differ by food variety, preparation, portion size, and data source updates
- Risk categories (such as Low, Moderate, and High) are simplified groupings for convenience
- The food catalog is informational and not a substitute for individualized dietary guidance from a qualified professional
We may update the bundled catalog from time to time as source data or app versions change.
6. Your Content and Local Data
You may enter personal health-related information into the App, including flare details, lab values, medications, and notes.
You retain ownership of the content you enter. Because the App stores data locally on your device, you are responsible for:
- The accuracy of information you record
- Backing up your device if you want to preserve data outside the App
- Using Delete all data or uninstalling the App if you want to remove local records
We do not operate a cloud backup or sync service for your health logs as part of the App.
7. Acceptable Use
You agree not to misuse the App. For example, you must not:
- Use the App in violation of any applicable law or regulation
- Attempt to interfere with the App’s operation or security
- Use the App to provide medical care, diagnosis, or treatment to third parties as a regulated healthcare service
- Misrepresent the App’s capabilities to patients, clients, or the public
8. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how information is handled. The Privacy Policy is incorporated into these Terms by reference.
9. Intellectual Property
The App, including its design, software, text, graphics, and bundled reference data compilation (excluding underlying public-domain or third-party source data itself), is owned by CodeWithChris or its licensors and is protected by intellectual property laws.
These Terms do not grant you any rights to our trademarks, logos, or branding.
10. Third-Party Services
The App relies on third-party services, including:
- Apple App Store — distribution and payment processing
- RevenueCat — purchase validation and entitlement management
Your use of those services is subject to their terms and policies. We are not responsible for third-party services outside our reasonable control.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- Food values, insights, or summaries will be accurate, complete, or suitable for your needs
- The App will meet your medical, dietary, or health-related expectations
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CODEWITHCHRIS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
This includes, without limitation, damages arising from:
- Reliance on information in the App
- Health, dietary, or treatment decisions you make
- Loss of locally stored data
- Unauthorized access to your device
- Third-party services such as Apple or RevenueCat
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow limitations of liability, so some of the above may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless CodeWithChris from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, your content, or your violation of these Terms.
14. Termination
These Terms remain in effect while you use the App. We may suspend or terminate access to the App if you violate these Terms or if required for legal or App Store compliance.
You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.
15. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes may also be noted in the App. Your continued use of the App after revised Terms become effective constitutes acceptance of the changes.
If you do not agree to updated Terms, you must stop using the App.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
17. Dispute Resolution
Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.
If informal resolution is not successful, any dispute arising out of or relating to these Terms or the App will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where applicable law requires disputes to be brought in your local courts.
Nothing in this section prevents either party from seeking injunctive relief for unauthorized use or intellectual property infringement.
18. Apple App Store Terms
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and CodeWithChris only, not Apple
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for any product claims, intellectual property claims, or third-party claims related to the App
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government prohibited or restricted party list
Where Apple’s standard Licensed Application End User License Agreement applies, it supplements these Terms for App Store distribution.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any purchase terms presented in the App Store at the time of purchase, constitute the entire agreement between you and CodeWithChris regarding the App and supersede prior agreements on the subject.
