These Terms and Conditions (“Terms”) govern your use of the Scoliosis Brace Hours Tracker mobile application (“the App”) provided by Code With Chris (“we,” “us,” or “our”).
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App
Scoliosis Brace Hours Tracker helps you log scoliosis brace wear time, view adherence against a prescribed goal, and generate reports for personal or clinical use. The App runs on your iPhone and stores your entries locally on your device.
2. License
Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules set forth in the Apple App Store Terms of Service.
You may not:
- Copy, modify, or create derivative works of the App except as permitted by law
- Reverse engineer, decompile, or disassemble the App except as permitted by law
- Rent, lease, lend, sell, or redistribute the App
- Use the App for any unlawful purpose
3. Purchases and Subscriptions
The App offers paid access after onboarding. Available options may include:
- Lifetime purchase — a one-time, non-consumable unlock
- Monthly subscription — recurring access, which may include a free trial period when offered through the App Store
All purchases are processed by Apple through your Apple ID. Pricing, trial length, and renewal terms are displayed in the App and on the App Store product page at the time of purchase.
Subscriptions
If you purchase a monthly subscription:
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown in the App Store
- You can manage or cancel subscriptions in your Apple ID account settings after purchase
- Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription, where applicable
Restore Purchases
You may restore previously purchased access on a new or reset device using the Restore Purchases option in the App, subject to Apple’s and our purchase verification systems.
Refunds
All billing and refund requests are handled by Apple in accordance with Apple’s policies. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
4. Medical Disclaimer
The App is not a medical device and does not provide medical advice, diagnosis, or treatment.
The App is a self-reporting tool. All wear times, adherence calculations, check-in entries, and exported reports are based on information entered by you or your caregiver. They may be incomplete or inaccurate if sessions are forgotten, edited incorrectly, or not logged in real time.
The App is not a substitute for professional medical advice or clinical assessment. Always follow the guidance of your orthotist, physician, or other qualified healthcare provider. Do not disregard or delay seeking medical advice because of information shown in the App.
If you think you may have a medical emergency, call your doctor or emergency services immediately.
5. Your Responsibilities
You are responsible for:
- The accuracy of information you enter in the App
- Keeping your device and Apple ID secure
- Backing up your device if you want to preserve App data across device loss or replacement
- Using exported reports appropriately and sharing them only with parties you trust
- Ensuring that anyone who uses the App under your supervision (such as a child) does so with appropriate caregiver oversight
6. Data and Privacy
Your treatment data is stored locally on your iPhone. We do not operate user accounts or receive your brace-wear logs on our servers.
Our collection and use of purchase-related information is described in our Privacy Policy. By using the App, you also agree to the Privacy Policy.
7. Availability and Changes
We may update, modify, suspend, or discontinue any part of the App at any time. We do not guarantee uninterrupted or error-free operation.
We may change pricing or subscription offerings for new purchases in accordance with App Store policies. Changes to existing subscriptions are governed by Apple’s subscription rules.
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the latest version. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE ACCURATE, RELIABLE, COMPLETE, OR FREE OF ERRORS, OR THAT DATA WILL NOT BE LOST.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CODE WITH CHRIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow limitations on liability, so some of the above limitations may not apply to you.
10. Apple Terms
You acknowledge that:
- These Terms are between you and Code With Chris, not Apple
- Apple has no obligation to furnish maintenance or support for the App
- Apple is not responsible for any product claims, intellectual property claims, or third-party claims relating to the App
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary
Your use of the App must comply with applicable Apple terms, including the Apple Media Services Terms and Conditions and App Store Terms of Service.
11. Termination
You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to paid features if you violate these Terms, subject to applicable law and App Store policies.
Sections that by their nature should survive termination (including medical disclaimer, disclaimers, limitations of liability, and Apple terms) will survive.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.
Any dispute arising from these Terms or the App that cannot be resolved informally may be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where prohibited by applicable consumer law.
