Contact Code With Chris

These Terms and Conditions (“Terms”) govern your access to and use of the Seizure Tracker mobile application (the “App”) provided by Code With Chris (“we,” “us,” or “our”).

By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Questions about these Terms can be sent to care@codewithchris.com.

1. About the App

Seizure Tracker is a personal diary for logging seizures, auras, medications, and related notes, and for generating summaries you may share with a clinician. The App is designed to help you organize information for your own records and appointments.

The App is sold on the Apple App Store. Your use of the App is also subject to Apple’s applicable terms, including the Licensed Application End User License Agreement (“Apple EULA”) where required by Apple. If there is a conflict between these Terms and the Apple EULA regarding your use of the App obtained through the App Store, the Apple EULA controls to the extent of the conflict.

2. Not Medical Advice and Not a Medical Device

Seizure Tracker is a personal log, not a medical device.

The App:

  • Does not detect, predict, diagnose, treat, monitor, or prevent seizures or any other medical condition
  • Does not provide medical advice, emergency services, or clinical decision support
  • Does not verify whether medication was actually taken
  • Does not determine causes of seizures or medical conclusions from tags, charts, or summaries

All insights, charts, associations, and report language reflect what you logged, not verified clinical findings. Trigger tags and similar labels indicate associations recorded in the App, not proven causes.

In an emergency, call your local emergency number immediately. Do not rely on the App for urgent medical decisions.

Always follow the advice of your qualified healthcare providers. You are solely responsible for how you use information recorded in or exported from the App.

During onboarding, you must acknowledge this disclaimer before continuing to use the App.

3. Eligibility and Caregiver Use

You must be able to form a binding contract in your jurisdiction to use the App, or you must use the App with the consent and supervision of a parent or legal guardian.

If you use caregiver mode to log information about another person, you represent that you have the right and permission to record and store that person’s health information in the App.

4. Your Account and Data

No separate login

The App does not require you to create a Code With Chris account. Access to paid features is tied to your Apple ID and App Store purchases.

Your content

You retain ownership of the information you enter into the App. You are responsible for the accuracy, completeness, and legality of the information you log.

Your diary data is stored on your device and, if enabled, synced to your personal iCloud account through Apple CloudKit. We do not host your diary content on our servers. See our Privacy Policy for details.

Backups and loss of data

You are responsible for maintaining backups of important information. We are not responsible for data loss caused by device failure, deletion of the App, iCloud settings, operating system issues, or user error.

5. Subscriptions, Free Trial, and Lifetime Purchase

Seizure Tracker offers paid access to the App’s features.

Current offerings may include:

  • Monthly subscription with a free trial period, then recurring billing through Apple
  • Lifetime purchase, a one-time payment for ongoing access subject to these Terms and continued App availability

Prices, trial length, and product names shown in the App are determined by the App Store and may vary by region. The paywall and App Store product page display the price and terms that apply to your purchase.

Billing through Apple

All purchases are processed by Apple. By subscribing or purchasing, you authorize Apple to charge your Apple ID payment method according to the product terms shown at purchase.

For subscriptions:

  • Payment is charged to your Apple ID account
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account is charged for renewal within 24 hours before the current period ends
  • You can manage or cancel subscriptions in your Apple ID account settings

To manage subscriptions, visit apps.apple.com/account/subscriptions.

Free trial

If a free trial is offered, unused portions are forfeited when you purchase a subscription, where applicable under App Store rules. Trial eligibility is determined by Apple.

Restore purchases

You may restore prior purchases using the restore option in the App, subject to Apple’s and RevenueCat’s normal restoration rules.

Refunds

Refund requests are handled by Apple according to App Store policies. We cannot issue App Store refunds directly.

6. Acceptable Use

You agree not to:

  • Use the App for emergency monitoring or as a substitute for medical care
  • Misrepresent App output as a medical diagnosis, prescription, or verified clinical record
  • Reverse engineer, decompile, or attempt to extract source code except as permitted by law
  • Interfere with or disrupt the App or related systems
  • Use the App in violation of applicable law

We may suspend or terminate access to the App if you violate these Terms or use the App in a way that could harm us, other users, or third parties.

7. Reports, Export, and Sharing

The App can generate PDF reports from your logged data. You control if and how those reports are shared.

Once you export or share a report through email, messaging, printing, or any other channel, that copy is outside our control. You are responsible for sharing health information only with recipients you trust and only through channels you consider appropriate.

Reports include a disclaimer that the App is a personal log, not a medical device.

8. Notifications

The App may schedule local medication reminders if you enable them. Reminders are convenience notifications based on information you entered. They are not medical instructions, and we do not guarantee delivery if iOS notification permissions are disabled or affected by device settings.

9. Third-Party Services

The App uses third-party services, including:

  • Apple App Store and Apple platforms for distribution, billing, iCloud sync, and notifications
  • RevenueCat for subscription and purchase management
  • PostHog for anonymous product analytics

Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

10. Intellectual Property

The App, including its design, code, branding, and documentation, is owned by Code With Chris or its licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store and these Terms.

You may not copy, modify, distribute, sell, or lease any part of the App except as allowed by law or with our written permission.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT, FEATURES, REPORTS, REMINDERS, AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  • THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • DATA SYNC THROUGH ICLOUD WILL ALWAYS BE AVAILABLE OR ACCURATE
  • REPORTS OR INSIGHTS WILL BE COMPLETE, CURRENT, OR SUITABLE FOR ANY MEDICAL PURPOSE
  • REMINDERS WILL BE DELIVERED AT ANY PARTICULAR TIME

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODE WITH CHRIS AND ITS OWNER, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
  • USD $50

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Code With Chris from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the App
  • Information you enter, export, or share through the App
  • Your violation of these Terms or applicable law
  • Your logging of another person’s information without proper permission

14. Changes to the App and These Terms

We may update the App or these Terms from time to time. When we update these Terms, we will revise the “Last updated” date above. If changes are material, we may provide additional notice in the App or on our website.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the App and cancel any active subscription through Apple.

15. Termination

You may stop using the App at any time by deleting it from your device and canceling any subscription through Apple.

We may suspend or discontinue the App, or terminate or restrict your access, if required by law, if you violate these Terms, or if we reasonably believe continued access could create risk or liability.

Sections that by their nature should survive termination will survive, including disclaimers, limitation of liability, and indemnification.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

17. Dispute Resolution

Before filing a claim, you agree to contact us at care@codewithchris.com and attempt to resolve the dispute informally.

To the extent permitted by law, any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Nothing in this section limits rights you may have under mandatory consumer protection laws in your jurisdiction.

18. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy and applicable Apple terms, form the entire agreement between you and us regarding the App.
  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver: Our failure to enforce a provision is not a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent.
